Expungment/Background Check

I am in the process of getting a case that has been dismissed expunged, and have a few questions.  I am also in the process of filling out my SF-86 and am wondering if I need to say that I was arrested.  Under Virginia law it states that once a charge has been expunged, it is legal to say "no" that there was never an arrest for that expungement.  I am not sure if I should say that I was arrested or not?

The other concern I have is that, I am looking at applying for the Peace Corp, and they stat that even if a record has been expunged you must say what it was.  The application asks if you have ever had a case expunged.  Is that legal?   The catch is that they will not even consider your application for an entire year after the case was dismissed.  

Some what frustrating that I am held accountable for something I did not do.

You need to fill out on the form that you have been arrested. Since you were actually placed under arrest. Good to know you were cleared. OPM will check if you have a history. Albeit it was cleared, but nontheless you were put into the system. Good Luck...
