John Arthur Ackroyd


In June 1977, John Arthur Ackroyd raped Marlene K. Gabrielsen off Highway 20 in Oregon. Gabrielsen promptly reported the rape to police, who polygraphed both her and Ackroyd. Gabrielsen, a Native American, "failed" while Ackroyd, a white army veteran, "passed." Prosecutors declined to press charges.

In 1993, Ackroyd was convicted for the 1978 murder of Kaye Turner of Eugene, Oregon. Ackroyd, who died in prison in January of this year, is also suspected of murdering three other women.

The Oregonian today began publishing a 5-part investigative series by reporter Nicole Crombie titled, "Ghosts of Highway 20." Read part 1 of her series here:

This appears to be another case (like that of "Green River Killer" Gary Leon Ridgway) where misplaced reliance on the pseudoscience of  polygraphy ended in the murder of innocents.

The Oregonian has published the 1977 polygraph reports for both John Arthur Ackroyd and Marlene K. Gabrielsen, who credibly alleges that he raped her at knifepoint. Both reports are attached to this post. For convenience, the salient portion of each report is transcribed below.

Polygraph "test" of Marlene K. Gabrielsen conducted by Sergeant Phil R. Ensminger of the Lane County Sheriff's Office on 28 June 1977:

On 06/28/77, per your request, Gabrielson [sic] was examined by the use of a polygraph to establish the voracity [sic] of a previous statement made to Detective Groat that on 06/12/77 at a location approximately one mile south of Highway 20, Old Santiam Road, she was. forcibly raped. (Your case 77-3596).

Gabrielson was administered a modified zone of comparison polygraph examination consisting of a series of relevant and irrelevant questions: the relevant questions and Gabrielson's answers thereto are as follows:

39) Whether or not you told Detective Groat the complete truth concerning your being raped, do you intend to answer truthfully each question about that? ANSWER: Yes.

33) Do you actually feel you were raped as you descriebde to me? ANSWER: Yes.

35) Did you tell Detective Groat the complete truth about your being raped? ANSWER: Yes.

26) Is there something else you're afraid I'll ask you a question about even though I told you I would not. ANSWER: No.

Specific responses to the above relevant questions were observed during the aforementioned polygraph examination and it is the opinion of this polygrapher that Gabrielson was not truthful in her answers to these questions.


Polygraph "test" of John Arthur Ackroyd conducted by Oregon State Police trooper Willard L. Prater on 21 September 1977 (nearly three months after Gabrielsen's polygraph "test"):

REFER: To Linn County SO Case #77-3596

ISSUE: The victim, MARLENE K. GABRIELSEN, [redacted], alleges that subject raped her at knifepoint. In her statement, Mrs. Gabrielsen said that the above mentioned John Ackroyd had agreed to give her a ride from Sisters to her residence. While enroute, she fell asleep in the cab of Ackroyd's pickup. The statement says that she was awakened by the suspect dragging her from the pickup and ripping her clothes from her body. The suspect had a large hunting knife in his hand and cut her underwear from her. She stated the suspect then laid her on the ground and had sexual intercourse with her, with the knife in his hand at all times. The victim stated that she fought the suspect to no avail. John Ackroyd denies the above allegations. He stated that he did give the woman a ride from Sisters and that while they were westbound on Hwy 20 she laid her head down in his lap and began fondling his thingy. She then told him "why don't you pull over somewhere and we can have some fun". Ackroyd stated that he drove off of Hwy 20 and up Old Santian Rd. where, after stopping the pickup, the alleged victim began undressing herself. Ackroyd stated that Mrs. Gabrielsen was the aggressor in the sexual activities that followed and that he at no. time produced a knife or any other weapon.

RELEVANT QUESTIONS:

#3 - Did the girl ask you to pull over and have some fun? Answer "Yes"
#5 - Did you force that girl at knifepoint to have sex with you? Answer "No"
#8 - Did you have a knife in your hand while you were having sexual intercourse with her? Answer "No"
#9 - Did you tear her bra off? Answer "No"

No deception was noted in the subject's responses to above relevant questions.

If you believe the reason Marlene's rape wasn't properly investigated was the "pseudoscience of a polygraph" test, cases like this will continue to happen. Polygraphs are essentially junk science, however, it's almost besides the point. This woman was ignored and dismissed because she is Native and he was white. The polygraph was simply a tool the police used to disguise their overt racism.

Lt. Holm, the police officer who questioned Ackroyd, asked him if remembered taking a polygraph about the incident. Ackroyd answers by saying he doesn't remember doing so. Lt. Holm then says, "Oh you didn't? I think you did...I think you passed" and they both laugh.
