Title: Information I provided was used against me!

I recently took the poly at NSA. I already had a TS/SCI through the Reserves. Had to go back 3 times. About 2 months later, I got a call from my civilian security manager who informed me that my TS/SCI had been temporarily suspended pending an investigation. I called an attorney and he pulled my JPAS which showed my Reserve commander had yanked my clearance completely based on information that was given to him provided by me in the interview. Is there any chance of reconciling with my Reserve unit to get my TS/SCI back? I could care less about getting access to NSA as they are now a bunch of weasels in my eyes, I just would like my old clearance back so, I can retain my job in the Reserves. Currently, I had to go inactive Reserve to figure out mt situation. I contacted an attorney who said it would cost me around 12k to appeal. I'd rather spend that money on a nice vacation to the Bahamas rather than pay for my attorney to go to the Bahamas. Any insight would be much appreciated.

Have you received a Statement of Reasons (SOR)?

Sorry for the late response and no I haven't received any documentation or "SOR" from the NSA. I even used the forms that I got from this site to file formal release of Privacy Act info to request all of my interview records. I received a response from the NSA back in November saying that it is being processed but, haven't received anything else since. When I pulled my JPAS, it show an incident history with date and shows the incident criteria and also has Unclassified Description that states "Information obtained from outside agency disclosed blah blah blah". So, I gather that my Reserve Unit commander was notified of my forthcomingness and suspended my clearance. DSS never contacted me either about the incident report. Would I be safe in assuming that they are gathering the evidence as we speak before approaching me. If so, how do I handle an investigator because at this point I will not allow myself to roped into any interview with any investigator without legal counsel present. Do they have the right to summon me at will to talk with me with out legal counsel as this is what an attorney told me?

Anyone have any insight or experienced a similar matter themselves? I'm wondering if it is worth spending the globs of money for an appeal defense with the chance that the appeal is denied (minimum $10K out the window).

Also, is there a time factor i.e. if I wait several years and then appeal or attempt another application, how does that affect things?

Debo..From my POV( I am not an attorney), it looks like they have their minds made up. However, do some research and find out if the VA can steer you towards competent legal counsel that won't cost you that much for an appeal and/or removal of derogatory info. On the other hand don't give up without a fight, but simultaneously, don't bankrupt yourself either.

On a final note, I highly advise against talking to anyone without an attorney, especially when the clause "Pending an investigation" is still in effect and present.
