I failed a State Police poly in the past. I am also awaiting several federal poly's (DEA, FBI, USSS). Will Federal LE agencies view that "failed" poly negatively? Will it stigmatize me?
I assume that I will get the following question during my Fed poly ? "Have you ever taken a poly before?", "If so, what were the results?". I also assume that since I have to tell him I 'failed' a police poly previously, that I am already branded a 'liar' in his eyes, and doomed no matter what?!
Given what I have read, that for a polygrapher to 'pass' you after you have 'failed' a previous poly, would be too indicate just how subjective and inaccurate they really are! And I guess polygraphers don't like to admit that.
I also feel like filing a lawsuit with the ACLU over my results. In my last poly they were very intent on asking in the pre-employment questionnaire, "if you have ever sued anyone and what was the reason." I assume that if I tell future polygraphers that I have sued a former polygrapher, that I am also doomed to fail before i even take a seat!!
Any ideas / comments?
If you fail the federal ones, you can look into Mark Zaid's lawsuit against the major federal agencies. As for the state one that you already failed, they should have some kind of appeals process. I would exhaust the administrative appeals process before a visit to the ACLU.....assuming you still want to work there.
I hope you get a fair shake. Be prepared not to though.
