Title: How far up does it go?

I failed a polygraph with a state agency.  Does that information go to the FBI and will I have a file started?  Can it be discovered in a backgroud investigation and used against me while applying for a job that does not require a polygraph?  Even if it is another job within the state?

When I took the polygraph, it was stipulated that the information would be confidential, and could only be known to me, my examiner, and the agency that was requiring the test.  If I am excluded from employment to another agency on the basis of failed polygraph, do I legally have a leg to stand on because the information was revealed to others?

To the best of my knowledge, no. Unless you made an admission regarding a federal crime, no report would be routinely made to the FBI.

Yes, quite possibly. It is not uncommon for state and local law enforcement agencies to share information regarding applicants.

You might. Did you receive this stipulation in writing? Bear in mind, however, that other agencies with which you apply may require you to sign a form authorizing the release of any and all records pertaining to previous applications for employment with other agencies.
