Oxidax,

You should absolutely refuse to take the "lie detector" test. You cannot be prosecuted or arrested simply for refusing the polygraph: a person's refusal to submit to this unscientific procedure is not admissible as evidence in a court of law.

Note that your manager has already violated section 2002(1) of the Employee Polygraph Protection Act (EPPA),  which makes it unlawful for an employer "directly or indirectly, to require, request, suggest, or cause any employee or prospective employee to take or submit to any lie detector test."

Your bank could already be liable for substantial damages under the EPPA. If you are terminated or otherwise retaliated against for refusing the polygraph, the bank's liability could increase. I suggest that you consult a lawyer with a background in labor law regarding your legal options.

I work at a Bank and there seems to be money missing in the Vault.The manager has been asking the tellers to come clean because the police will start and investigation we will have to take a "lie detector" test. I have an eye witness that I have never stolen money from the vault because that person supervises me when I go and whitdrawl money from it every time I have to.Also,I haven't seen any poster with the "Act" or received any witten letter regarding this test. Should I refuse ? I seriously don't care if I get fired because i prefer getting another job rather than failing to a unreliable machine. I still don't know if the right procedures are being followed (EPPA poster,Written letter,etc etc) since i was just told but not notified and i dont see any poster in the brake room nor anywhere else.would i get prosecuted or taken to jail even if I refuse? I dont want to take it but im scared of what will happen if I dont! Thanks
