How to appeal a failed TSA polygraph above the quality control division.

Hello, I recently took a polygraph for the TSA and I had a rather troublesome experience. Before I even sat down the examiner asked if I was married. I told him that I wasnít and he asked why not. I explained that I had just chosen not to marry and that Iím 40 and I like being single. He seemed to be put off by my response so I asked him why my marital status mattered. He said that the first question he likes to ask married guys is about the dating or cheating apps they use to cheat on their spouse. I told him that I was single and that I didnít have any dating or hook up apps. He then looked at me and said ď you know some guys are chronic masturbaters and they need to masturbate once a week.Ē He didnít put this in question form but judging by his facial expression he clearly was asking if I was a chronic masturbator. During the rest of the interview he was aggressive and accusatory. I barely got a chance to speak other than to say yes or no.  At the end of the interview he told me that I had failed. He said that I had failed on the crimes against person question. I told him that I had been a crimes against persons detective for several years and that the phrasing of the question immediately brought up tons of memories of cases that I have worked over the years. He told me I should see a counselor to be able to not think about those things when taking a polygraph. I appealed the decision to the quality control section of the tsa and was told that all procedures had been followed. I donít see how itís the procedure of the tsa to ask about masturbation. If anyone know how to appeal a decision above the quality control section of the TSA please let me know. Also if anyone knows of a good attorney for a matter like this please give me their name and/or contact info. Iíve never committed a crime and I wonít have my career derailed buy a guy with too much power and his obviously unreliable little machine. Thank you

I had not previously heard of TSA requiring job applicants to submit to polygraph screening. May I ask what kind of position this was for? Were you given any explanation regarding why polygraph screening was required?

In your correspondence with TSA, did you receive any indication of the regulation that governs TSA's use of polygraphs?

A couple attorneys you may wish to contact are Mark Zaid and Kel McClanahan.

For now, if you haven't already done so, I think it would be prudent to write as detailed a memorandum as you can about everything that happened during your polygraph session.
