Sent forty miles from my home to a three hour test. The only parking in this very busy center was 90% permit parking and 10% 2 hour. Which ment I had to sometime in the middle of this exam go move me wheels. Very stressful! Just before hookup the examiner tells me of a story back in his college days how he got so drunk that the next day when his friends told him he had done something inappropriate he claimed to have no recollection of any such thing. After the test he repeated the same story and proceeded to do an after test interview. He claims I failed the test miserably and he thinks that I should confess to something or anything. He takes the results to the person responsible for the final evaluation and tells that person that I practically admitted that something did happen. The whole event was taped which I had signed off prior to the test. I said nothing that even came close ressembling a confesssion. Do I have a right to a copy of that recording?

I see your dilema.  It is a private agency used by the state to conduct. If they were to release this info to the public they would more then likely be owned by a different COO each and every week. So there is no access. The chain of command is the court turns a matter over to a P.O. The P.O. calls the same psychology center that they have been dealing with for years. The psych center replies with is this another push? The P.O replies yes. The psych center calls polygragher who does what he/she wants to knowing that no matter what this matter is closed and no one can access the results. It is quite a closed system. When you get out of court an arrow is released heading for the Bulls Eye and no one along the way dares deflect that arrow. No one looks up, down, to one side or the other. It is assumed that the accused does not have any recourse. Is in fact at the mercy of the P.O and any thing that he/she wants to do is Gospel. George,Respectfully lay down your law book and grasp the fact that all the education in the world is not going to help me. If you find a way to circumnavigate this one I will lend you my talent for the rest of your life. I have three FAA certifications so I am not a dummy.I'm not law savy. Just a blue collar who got caught up in very unfortunate situation. Thank You very!very! much for your interest in this case. I hope that some how this will open a slightly different outlook on the system that has executed way to many innocent people.

That's nice GW. This was post plea deal conviction. I was hoping to learn enough to determine if pursuing an outright lie made by an polygragher was plausible. I need a copy of the audio made during the exam. If I get that as recorded it will show I made no such statement as he/she is claiming. I will retain counsel to see. The state is Ma. They do not allow polygragh in the court system. But now are using one and a lie to force me to take programs I know will do me no good. Don't get me wrong I love a good education but somethings you learn on your own over time. Thanks GW will let you know how things are going down the line.
