Can my son go to jail if he fails the polygraph  the 2nd time?
He is 16 years old, he was told that he well be listed as a sex offender and have to go to jail. this all started when he was 14 years old. My son said that he told the truth and that he has nothing to hid. he is being asked questions at the time the offence happened and that was when he was 13 years old, by the way he did not have sex with the girl he touched her in the wrong spots

Your best course of action, if your son is facing prison, would be to retain competent legal counsel.

It would be difficult if not impossible for anyone on this board to guess possible consequences your son might be facing without a great deal more information.

Hello Mr. Goodrf,

If your son continues to tell the truth, he won't have a problem passing the polygraph test.  As the old saying goes, the TRUTH with set you free.

You didn't give enough info.

How did he come to take a polygraph? Who suggested he take a poly? Was it your son's choice to take it or was it suggested by LE? Your son cannot be required to take one unless he has already been convicted and his sentence included it as part of SO treatment. In all but 4 states, I believe, poly results cannot be intered as evidence in court unless YOU agreed to it beforehand.  Your son is a minor, which also, brings up the question of the legality of subjecting him to a polygraph.

Take the sargeant's advice and get legal help. Forget polyman's BS. A punitive polygrapher can jack some adults up enough to fail when they are telling the truth. They can turn a kid inside out.

I'll go a step further.  Yes, polyboys will say to do no more than tell the truth and be at peace, that all will be okay, that they're only there to help you and move you along on your path to a job...

There was once also this encouraging inscription on a gate outside a rather large confinement facility that read "Arbeit Macht Frei."

Work Makes You Free.

That sign was on the front gate of Auschwitz...

Polygraphers escaped from among the evils of Pandora's box, which might have been an old analog polygraph... only God can tell whether you're lying or not, and He will judge you in His own time...

Hmm. Sounds like he touched her in the right spots. Sorry.
