Expunged Arrest Record

Hello,

I was arrested eight years ago for possession of a category three controlled substance.  The police realized that I had acquired the controlled substance out of ignorance (I truly didn't know the substance was illegal), so the decided not to press charges and my arrest record was expunged.

If I am applying for a Top Secret clearance, do I need to reveal this?  Will DSI find out about the record expungement?

When i was 14 i got arrested for harrasment and criminal mischief. They were both expunged when i applied to do so. Since then i talked to many military recruting personnel and family friends that are in the intelligence division of the military as well. Expungement does not mean what it really says. If a cop pulls you over and looks up your record it is most likely that he wont be able to see your past that has been expunged. But if military or any other federal agencies look it up they will definitly see it. If your offense is something that was expunged it shouldnt be that big of a deal. Especially when you havent done anything for the past 8 years. I think that they would appreciate the fact that you came forward to say what you did in the past before they have to find out. And they WILL find out about it. Again expungement doesnt really mean it is erased. Also if you explain your story first they will understand your story. Its better to here the story then to look something up on the computer that says you were in possesion and it was expunged. Good Luck, if you are qualified enough for the job it should not be a problem.

You are absolutely correct.  I didn't take a polygraph, well not yet anyway.  However, when I was interviewed, I just came clean with everything.   I was selected for the job.  I think they respected the fact that I was candid.  They were caught off guard by my candor, because they didn't find it in my initial background check

There is no such thing as an explunged record to the military, you will tell the truth on this one, bud. After that, you will most likely be given a waiver (which is an exception to policy and waivers are very common) and be required to write a statement explaining the facts.
