Hello there! I recently failed a polygraph with unnamed agency and I read on this web site that the "yes test" was primarly given to those who are suspected of using countermeasures, in which, I did not! Probably should have! I was told I failed the "Have you ever sold illegal drugs?" question. (When I have NEVER sold illegal drugs!)  After two sets of questioning, I was given the "yes test." Is it possible that the examiner suspected me of cheating, when I did not? Does anyone know what the "yes test" really is? Just trying to figure out how I failed this test, any replys would be helpful!

As for why you failed the polygraph, it is likely that you reacted more strongly to the relevant question about selling drugs than to the corresponding "control" question, which may have been something like, "Did you ever lie to someone in a position of authority?" That you were administered a "yes test" is some indication that you may have also been suspected of countermeasures. You'll find the "yes test" explained in the message thread Counter-countermeasure Techniques.

At this point, I think it would be prudent to appeal the results in writing, requesting a re-test. In addition, if your polygraph examination was with a federal agency, you might wish to contact Mark Zaid, an attorney representing several plaintiffs who are suing the federal government over its pre-employment polygraph policies. Thanks for the reply, though I can't understand why I would have higher reaction on the sell of illegal drugs when compared to a control question.  After the initial examination, I was given a "retest," in which the examiner added "often" at the end of all control questions, for example, "Do you often lie to persons in a position of authority?." 

Thanks for the info, I think I have better understanding of this procedure.  I have appealed my results with the agency and they contacted me.  Talked to them about another retest, however, I have not heard from them since.

The police agencies can use the poly as a "legal" guise to defer whom they please for what ever reason they please.  Not hearing from them is not the best of signs.  You should not have parked in the polygraphers stall during your exam.  He/she took it personal!  All kidding aside I wish you luck.  Keep us posted.
