Theoretical and/or Hypothetical question: 

I have often pondered what the policy might be “hypothetically” speaking, should pre-employment polygraph testing ever be banned completely with all Federal/State/LE agencies.

Question:
Anyone who has previously failed a "Federal", State, County, or Law Enforcement pre-employment polygraph test…

a) Could re-apply, and would be equally and fairly considered for employment with the same agency previously applied with, which resulted in a failed polygraph exam?
b) Could NOT re-apply due to a previously failed pre-employment polygraph exam on file?
c) Could re-apply, but would be unfairly discriminated against due to a failed pre-employment polygraph exam on file?
d) None of the above?

The Comprehensive Employee Polygraph Protection Act, if enacted, would require option "a," but in practice, I suspect that some agencies would implement option "c," which would result in litigation.
