Failed In Truth!!!

Aboout a month ago a computer was stolen from my wifes work. There was information on the computer that could be damaging to several people. An administrator was asked to resign or be fired. soon after, the same computer this person used was missing. There was alot of damaging e-mails sent from that machine about other employees and damaging to the business, due to wrong practices. within a month the company had decided to poly everyone. Unknowing  and relying on what the actual test is called "A LIE DETECTOR TEST" my wife was the first to sign up. They did the test and said my wife had a couple of strange answers. So I decided to do some research and found out this was all normal for the examiner to act like everyone is guilty. So I did the normal thing any husband would do knowing his wife has been falsely accused!. I confronted the so called manager that requested the employees take the test. Only to have him tell me they were not accusing her And they are sorry she is having a nervous breakdown. The test results were called back today and my wife fired On the spot through a conference call.(the bastard didnt even have the nuts to tell her himself). They said, She was the only one to fail the test Out of 11 people. The thing is she is not lying!!! she told the whole truth!!! And did not steal anything ever from her employer now or past! We did not get a test results report,in written form. What the hell do we do now??? any help would be appreciated...

I am not a lawyer, but I believe that your wife may have strong grounds for bringing suit against her former employer under the Employee Polygraph Protection Act. Under Section 2006(d), it appears that the employer's request that employees (who presumably had access to the missing computers) submit to polygraph "testing" was lawful. However, Section 2007(a) prohibits firing or otherwise discriminating against an employee based solely on an analysis of polygraph charts (or refusal to be polygraphed).

I think you and your wife should consult with one or more trial lawyers experienced in labor law. Martindale's free Lawyer Locator service may be of assistance in this regard.
