Hello, I would like to know if anyone has any information on how to appeal a TSA polygraph above the quality control level. I had an examiner as me about masturbation habits. This question was asked after he found out that I am 40 and not married. I sent an email requesting a retest with a different examiner. The response from quality control was that the test was conducted in accordance with current tsa polygraph standards. The question was ask within the first couple of minutes of the “ chat before the test starts”. I would also like to know of a good attorney that I could contact about the experience. Thank you

stoppolyabusenow wrote on Dec 5th, 2007 at 10:40pm:

I think that it is a gross injustice that the federal government is allowed to subject its loyal empolyees to polygraph harrassment and abuse. If the polygraph isn't going well, the session quickly turns into an adversarial interrogation. Then, the loyal emploee, is berated, accused of sexual deviancy and accused of treason. This can go on for hours and hours and the loyal employee, who desperately wants to pass, keeps putting up with the abuse for hours, hoping to convince the polygrapher that he/she is telling the truth. The fact of the matter is, once they have made up their minds, no amount of talking will change their minds. I was interrogated, berated, accused of treason by two men for hours, while strapped to a chair. This session became very personal and ended with me admitting to being raped. The polygraph perverts wanted to hear all of the details and just refused to believe that I wasn't a traiter.
I have been a loyal government employee for 21 years and I was treated worse than any criminal that I have ever interviewed. I just can't believe that it is ok to subject our own people to this type of abuse/torture. I still haven't passed the test and my career is ruined, all for nothing. It is all bullshit, but there is nothing I can do about it.
There was a lot of lying going on in that room, but all of it was coming from the polygraphers. I find it ironic that I was being berated for being a liar, when I was telling the truth, and the polygraphers lied to me throughout the process. It's just rediculous. The emperor has no clothes. The government wraps itself in the cloak of ploygraph security, but their is no cloak. They don't catch any one, except for getting people to admit they smoked pot 20 years ago. They certainly didn't catch Proutty. If we had been spending more money on BIs, instead of contracting those out and relying on the stupid polygraph, we would be much more secure.

This has essentially <img rel=">:(" src="https://antipolygraph.org/yabbfiles/Templates/Forum/default/angry.gif" alt="Angry" title="Angry" /> been my experience with the polygraph, too, at two federal agencies.

Unfortunately, as I've learned from actual experience, the BI process can be flawed as well.
The federal polygraph litigation remains active, although half of the plaintiffs have settled their claims by essentially dropping out. The court recently denied our attempt to depose former FBI Director Louis Freeh, although without prejudice.

Each side will be submitting a Motion for Summary Judgment by August 1, 2005. I envision several months of briefing, possibly oral arguments, and then ultimately a decision, hopefully sometime next year.

I apologize if you have contacted me and not received a response. It has been very difficult to respond to all the inquiries and, quite frankly, there is little I can do at this stage. While I am more than willing to take your money (!), it would be a waste for any more victims to join the litigation given the stage we are at. Should we succeed at this next level, then by all means everyone should join! But if we don't, then you would have wasted your time and money for nothing. Essentially whatever decision is obtained in the case that now exists will control because the facts in our case are just as good as any I have heard.

That being said, I could use everyone's help. If you have been denied employment by a federal agency due to the polygraph, whether in part or whole, AND you believe you have lost out subsequent employment at the federal, state or local level due to the initial polygraph results, please contact me ASAP at ZaidMS@aol.com.

Even if you are not in the litigation, you can help.

Thanks.

Mark S. Zaid, Esq.
Washington, D.C.
Quote:

When are you going to advertise your countermeasures to the urinalysis test. Oh thats right, if I do drugs and I'm wrong I will need them. I guess you will want to damage private property and ask people to write this on bathroom walls. I understand making a buck, but your ethics leave something to be desired.

If you're referring to The Lie Behind the Lie Detector, it should be noted that 1) no one has asked anyone to vandalize property in the spreading of information about the polygraph and 2) the book is free; there is no "making a buck" involved. Do these facts address your concerns about ethics?

If not, we could point out that 1) unlike urinalysis, the polygraph is not grounded in scientific evidence and solid theory backing its efficacy (in fact, quite the opposite is true), 2) if urinalysis produced a false positive, one would have the chance and the means to demonstrate this fact, and 3) information on "beating" a urinalysis test is already out there, and the methods and ways to counter the countermeasures are well-known.

In contrast, polygraphers appear to have no known way to counter countermeasures with any certainty of success, beyond bluff, based as the test is on a foundation of sand. Were this the case with urinalysis, it would be worthwhile to point out that that test could easily, undetectably and unstoppably be fooled and it were therefore unwise to depend upon it.

Skeptic
